1. Agreement to Terms

By accessing and using the GreenScape Landscaping website at greenscapelandscaping.com, or by engaging our landscaping services, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this website or our services.

2. Services

GreenScape Landscaping provides professional outdoor maintenance and design services including but not limited to lawn care, garden design, hardscaping, tree services, irrigation, seasonal cleanup, landscape lighting, and mulching. All services are subject to:

• A signed service agreement or written confirmation of scope prior to work commencing.
• Full payment or deposit as agreed in your service quote.
• Property access being available to our crew at the scheduled time.
• Accurate property information provided by the client at the time of booking.

3. Quotes and Pricing

All quotes provided by GreenScape Landscaping are valid for 30 days from the date of issuance. Final pricing is subject to change if the scope of work changes materially from what was originally assessed. Any changes to scope will be communicated to the client before additional work proceeds. GreenScape reserves the right to revise pricing for ongoing maintenance services with 30 days written notice.

4. Payment Terms

• Maintenance Services: Invoiced monthly on the 1st of the month. Payment is due within 14 days of invoice.
• Project Work Under $1,000: Payment in full is due upon project completion.
• Project Work $1,000 and Above: A deposit of 50% is required before work begins. The remaining balance is due upon project completion.
• Late Payments: Accounts overdue by more than 30 days are subject to a 1.5% monthly finance charge on the unpaid balance.

GreenScape accepts credit/debit cards, ACH bank transfer, and check.

5. Cancellations and Rescheduling

Clients may cancel or reschedule a scheduled service appointment with at least 24 hours advance notice at no charge. Cancellations made with less than 24 hours notice may be subject to a cancellation fee equal to 50% of the scheduled service cost. For ongoing monthly maintenance plans, cancellation requires 14 days written notice before the next billing cycle.

6. Weather and Safety

GreenScape Landscaping reserves the right to reschedule services due to unsafe weather conditions including extreme precipitation, lightning, high winds, or temperatures below 25°F. Rescheduled appointments will be offered at the earliest available slot at no additional charge. We are not liable for delays caused by weather or other circumstances beyond our reasonable control.

7. Property Access and Preparation

The client is responsible for ensuring property access is available at the agreed service time. This includes unlocking gates, securing pets, and removing obstacles that may interfere with our crew's work. GreenScape is not responsible for delays or incomplete service resulting from inaccessible areas of the property.

8. Damage and Liability

GreenScape Landscaping carries full general liability insurance and workers' compensation coverage. In the event that our crew causes damage to your property through negligence, we will make commercially reasonable efforts to repair or compensate for the damage. The client must report any damage claim within 48 hours of service completion. GreenScape is not liable for:

• Damage to underground utilities, irrigation lines, or cables not disclosed prior to service.
• Natural plant death due to disease, pests, drought, or seasonal conditions after planting.
• Pre-existing conditions not identified during the initial property assessment.
• Damage resulting from the client's failure to follow post-service care instructions.

9. Plant and Material Warranty

GreenScape Landscaping warrants installed plants against defects for a period of 30 days from installation, provided that the client follows our recommended watering and care instructions. This warranty does not cover plant loss due to drought, extreme weather events, pest infestation, or neglect. Hardscaping materials are warranted against defective installation for 1 year from project completion.

10. Intellectual Property

All content on the GreenScape Landscaping website, including text, images, graphics, logos, and design elements, is the property of GreenScape Landscaping and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use any website content for commercial purposes without our express written permission.

11. Limitation of Liability

To the fullest extent permitted by law, GreenScape Landscaping shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability to any client shall not exceed the total amount paid by that client for the specific service giving rise to the claim in the 12 months preceding the claim.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Oregon. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Multnomah County, Oregon.

13. Changes to Terms

GreenScape Landscaping reserves the right to modify these Terms and Conditions at any time. Changes will be posted to this page with an updated "Last Updated" date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.
